FROM THE EDITOR

RITA GARWOOD, EDITOR ABF JOURNAL

WHILE THE BANKRUPTCY INDUSTRY HASN’T CHANGED MUCH OVER THE LAST YEAR,

the same cannot be said for ABF Journal. Our magazine has a fresh, modern look as do our new digital edition and daily e-news. Drop us a line at news@abfjournal.com to share your thoughts on our redesign.

We aren’t the only ones in the industry that are embracing the spirit of innovation. According to a recent Capital One survey, middle-market companies have moved beyond their fear of disruption to embrace emerging technology and use it to drive innovation. Bob McCarrick, reporting on this research, says banks must follow suit by offering products to streamline customer financial processes.

As the “retail apocalypse” has swept across once-successful mainstays, the Honorable Michael B. Kaplan wonders if leveraged loans have contributed to this trend. He discussed this and other notable Chapter 11 trends with ABF Journal in an exclusive Q&A.

Although retail filings have once again taken the spotlight in 2018, the number of Chapter 11 filings have continued to hold steady. ABI’s Samuel Gerdano and Ed Flynn examine the bankruptcy landscape and provide an outlook for 2019.

Wrapping up our special bankruptcy content, Andrew I. Silfen and Beth M. Brownstein from Arent Fox’s Bankruptcy & Financial Restructuring practice provide tips to achieve closure of a Chapter 11 case and indenture-related issues without implicating the exculpation provisions.

In our New on the Scene profile, Associate Editor Amanda Koprowski interviewed Donald Lewis, who was recently appointed head of Eastern Bank’s Asset-Based Lending division. Grateful to the mentors who have guided his career, Lewis is excited about the opportunity to pay it forward and lift up those who work with him.

In Turnaround Corner, Joseph D’Angelo explores turnaround options for post-secondary education institutions currently facing sustained stress. In Specialty Lending, Chris Curtin shares first-hand advice on invoice factoring for natural disaster clean up work. In Legal Lines, Michael Fielding discusses the power of properly implemented forbearance agreements, which can create a win-win result for both parties involved in a troubled loan.

Last, but definitely not least, I’m excited to introduce a new ABF Journal feature, By the Numbers, which shares vital data presented in the magazine in an easy-to-digest infographic format. We hope you will enjoy it!

We’ll see you in March for our Specialty Lending issue.
